Graphics Designs Services – Terms & Conditions

The designer agrees to provide graphic design services strictly as discussed and mutually agreed upon in writing (WhatsApp, email, or formal agreement). Any work outside the agreed scope—including additional concepts, revisions beyond the agreed limit, resizing, format changes, language changes, or reuse of designs for other purposes—shall be treated as additional work and may be charged separately.

The client confirms that all content provided to the designer, including but not limited to text, images, logos, brand names, trademarks, slogans, photographs, illustrations, and reference materials, are legally owned by the client or that the client has obtained proper authorization to use them. The designer shall not be responsible for any copyright infringement, trademark violation, defamation, or legal dispute arising from the use of such client-provided content.

If the designer uses any stock images, icons, fonts, mockups, templates, or third-party design elements—whether free or paid—the responsibility of verifying licensing suitability for the client’s intended use (commercial, promotional, digital, print, resale, etc.) lies solely with the client. Once the client accepts the final design, the designer shall not be held liable for any copyright, licensing, or legal issues arising thereafter, regardless of the source of the design elements used.

The client is solely responsible for reviewing the final design for accuracy, spelling, factual correctness, brand compliance, and legal suitability before approval. Acceptance of the final design—whether explicit or implied by usage, publishing, printing, or payment—confirms that the client has fully reviewed and approved the work and assumes complete responsibility for its use.

The designer does not guarantee any specific results, performance, approvals, reach, engagement, or commercial success of the design. Any rejection, restriction, or penalty imposed by platforms, printers, advertisers, or authorities shall not be the responsibility of the designer.

Revisions, if any, will be limited to the number agreed upon before the commencement of work. Minor adjustments may be considered revisions; however, major changes in concept, layout, content, or direction after approval will be treated as a new project and may incur additional charges.

Delivery timelines are estimates and may vary depending on client feedback, timely submission of materials, scope changes, or technical circumstances. The designer shall not be held responsible for delays caused by the client.

Payment terms will be as agreed prior to starting the project. Advance payment may be required. Final design files will be delivered only after full payment unless otherwise agreed in writing. All payments made are non-refundable, as design services are time-based and creative in nature.

In the event of project cancellation after work has commenced, any advance payment shall not be refunded. Additional charges may apply depending on the amount of work completed at the time of cancellation.

The designer is not responsible for long-term storage or backup of project files after final delivery. The client is advised to download and securely store all delivered files immediately.

Unless explicitly restricted in writing, the designer reserves the right to showcase completed designs in portfolios, case studies, or promotional materials. Confidential or unreleased designs will not be shared without permission.

The designer’s total liability, if any, shall be strictly limited to 50% of the amount paid for the specific design service. Under no circumstances shall the designer be liable for any indirect, incidental, consequential, legal, or third-party claims arising from the use of the design.

All disputes, if any, shall be governed by the laws of India, and jurisdiction shall lie with the designer’s local courts.

By assigning the project, approving the design, making payment, or using the design in any form, the client confirms that they have read, understood, and agreed to these Terms & Conditions in full.
